Terms and Conditions

Welcome to Flowrush Digital Marketing (“Flowrush”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and services. By accessing our website or working with us, you agree to be bound by these Terms. If you do not agree, please refrain from using our site or services.

Company Overview

Flowrush Digital Marketing is a performance-first digital agency offering a range of services including website and e-commerce development, SEO, paid ad campaigns (Google Ads, Facebook, Instagram, LinkedIn), social media marketing, brand storytelling, content production, CRM/email marketing integration, and analytics. Each service is tailored to the client’s goals, with scope and deliverables outlined in formal proposals.

Website Usage

By accessing www.flowrush.in or any associated domains, you agree not to use the website for any unlawful or unauthorized purposes. You are prohibited from duplicating, modifying, distributing, or exploiting any website content without written consent. Misuse of the platform or interference with its functionality will result in revoked access and may involve legal consequences.

Scope of Services

All service engagements are based on a mutually agreed scope that defines specific deliverables, timelines, pricing, and communication protocols. Any work outside of the agreed scope will be treated as an additional request and may be subject to revised costs and extended delivery schedules.

Client Responsibilities

Clients must provide all necessary assets (e.g., logos, content, access credentials) in a timely manner, appoint a single point of contact, and respond promptly to our communications. Delays in approvals or asset delivery may result in project delays or additional charges. It is the client’s duty to ensure internal coordination and alignment on the project.

Payment Terms

All services require advance payment as stated in the individual service agreement or invoice. Typically, a 50% upfront payment is required to begin work, with the remaining 50% due upon delivery or milestone completion. Payments must be made within the time frame specified on the invoice, usually 15 days. Late payments may result in service suspension or late fees.

Refund Policy

All payments made to Flowrush Digital Marketing are non-refundable. Once a project is initiated, refunds will not be entertained under any circumstances, including client cancellation or dissatisfaction due to change in internal business strategy. This policy exists because we allocate team resources, planning, time, and tools immediately after project confirmation. Clients are advised to carefully review service proposals and resolve all doubts prior to making a commitment.

Intellectual Property

Flowrush retains full ownership of all intellectual property—including content, designs, strategies, source code, and digital assets—until complete payment is received. Once the client clears all dues, they are granted the rights to use the final deliverables. We reserve the right to feature finished work in our portfolio unless a non-disclosure agreement has been executed.

Confidentiality

Both parties agree to maintain confidentiality over sensitive business information, proprietary strategies, financial details, trade secrets, and any other material not publicly disclosed. Confidential data shared during the course of engagement will not be used for any purpose beyond the scope of service delivery.

Limitation of Liability

Flowrush shall not be held liable for any indirect, incidental, consequential, or punitive damages, including but not limited to, lost profits or business interruptions arising from the use or inability to use our services. Our liability, in any case, shall not exceed the total fees paid by the client for the specific service in question.

Termination Clause

Either party may terminate the agreement by providing written notice in case of a material breach that is not resolved within 15 business days. Upon termination, the client is required to pay for all work completed or in progress. Flowrush may withhold unfinished assets or documentation until dues are cleared.

Modifications to Terms

Flowrush reserves the right to amend these Terms at any time. The updated version will be posted on our website. Continued use of the website or services after any modifications constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms will fall under the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
